Holiday Decoration Contest

The judging for the Trails Annual Holiday Decorating Contest was done on December 17, 2011.  Prizes were awarded as follows:

Harris Co. Fire Marshall Order

Harris County Fire Marshall Office has issued an " Order Declaring a Diaster and Restricting the Sale, Dispensing, or use of Fireworks in the Unincorporated Areas of Harris County".  The Burn Ban also remains in effect.

As recommended by the Harris County District Attorney's Office offenses are a Class B and To Be Warrants for arrest can be issued at a later date.  This option does not remove the ability to affect an immediate arrest.

SPARKLERS AND OTHER FIREWORK NOVELTIES PROHIBITED UNDER BURN BAN

(Harris County, TX) – With the 4th of July holiday quickly approaching; the Harris County Fire Marshal’s Office reminds residents that all fireworks are banned in the county and that a burn ban remains in effect.

“Sparklers, novelties and trick noisemakers are not classified as fireworks but they are a source of ignition and emit sparks that are not contained; therefore, they are included in the outdoor burn ban,” said Harris County Fire Marshal Mike Montgomery.

According to officials, the wildfire danger is so great that even a carelessly discarded sparkler could ignite dry grass very quickly.

The number of outdoor fires in unincorporated Harris County reported to the Fire Marshal’s Office since April 19, the first day of the burn ban, is 1,090.  Almost half of those fires have occurred since June 1.  There were 125 reported outdoor fires in the unincorporated county last week, including this weekend.

Violators of the fireworks ban face a $1,000 fine and/or 180 days in jail.  Violators of the burn ban face a fine of up to $500 for each violation.

The ban on the sales and use of fireworks is expected to remain in place until the end of the extension period granted by Governor Rick Perry.

ORDER DECLARING A DISASTER AND RESTRICTING THE SALE, DISPENSING, OR USE OF FIREWORKS IN THE UNINCORPORATED AREAS OF HARRIS COUNTY.

Section 3.
This declaration includes the following restrictions upon the sale, dispensing, or use of fireworks throughout the duration of the local state of disaster declared by this order, except as provided in Section 4: The sale, dispensing, or use in the unincorporated area of Harris County of fireworks that are classified as Fireworks 1.4G, as that term is defined by Texas Occupations Code§ 2154.001(7), is prohibited and shall remain prohibited thereafter through the duration of the local disaster declared by this order.

Section 5.
As provided in the Harris County Emergency Plan, a person who voluntarily fails to comply with the Harris County emergency management plan or with a rule, regulation, or Order adopted under the Harris County emergency management plan commits an offense and, upon conviction, is punishable by a fine of not more than $1,000 or confinement in jail for a term of not more than 180 days or such fine or confinement in jail as is the maximum set by section 418.173 of the Texas Government Code as it may be amended from time to time.  A rule, regulation, or Order adopted under the Harris County emergency management plan may set a lesser punishment for its violation, which lesser punishment shall then apply. TEX. GOV'T CODE ANN. § 418.173 (Vernon 1998). A person who violates the restrictions set forth in this order is subject to the maximum penalties provided. Definition of “Fireworks 1.4G” Texas Occupations Code 2154.001(7)

(7) "Fireworks 1.4G" means a small fireworks device:
(A) primarily designed to produce visible or audible effects by combustion, deflagration, or detonation;
(B) that complies with the construction, labeling, and chemical composition requirements of the United States Consumer Product Safety Commission in 16 C.F.R. Part 1507 (1996), or the most recently adopted version of that rule; and
(C) that is classified by the department in 49 C.F.R. Part 173 (1996).

Association Monthly Meeting

Atascocita Trails Association meetings will be held @ 7:00pm the first Tuesday of every month at the Pool house except for the month the "Annual Meeting" falls on.  Residents will always get a notice in the mail about the "Annual Meeting" as that is when we elect the Board of Trustees.  It usually will fall in March, April, or May.  Please attend the meetings and find out what's going on in your community.  Help to keep your community safe and clean.

Trash Burning Warning

The following information was received from the City of Humble concerning trash burning:

"Since you are in the county you are under the county Fire Marshal, Mike Montgomery.

Fire Marshal is Mike Montgomery and his office number is 281-436-8000 ext. 8121

Fire Marshal Montgomery said the LAW is the following:  If the person/resident has regularly scheduled "trash pick-up" the answer to burning is NO.  If the person/resident does not have regularly scheduled "trash pick-up" the answer is YES as long as it is contained in a barrel.

THE ADDENDUM TO THAT IS, IF ANY OF THE NEIGHBORS SURROUNDING THE PERSON BURNING COMPLAIN; THE FIRE DEPARTMENT HAS BEEN INSTRUCTED TO DISTINGUISH THE FIRE UPON ARRIVAL!  NO BON FIRES ARE ALLOWED AT ANY TIME ANY PLACE!

Anyone living in the "city limits" of the City of Humble:  burning is not allowed at any time; also same applies for the City of Houston. (Just an FYI)

Neighborhood Appearance Issues

It has been noted that we have some neighborhood appearance issues.  Some properties are not being properly maintained.  Proper property maintenance and attention to appearance enhance property values and security for the entire neighborhood.

Items specifically noted include:

  • Shopping carts brought from Walmart and left abandoned
  • Garage sale signs are prohibited by deed restrictions
  • Other yard signs are prohibited by deed restrictions
  • Trash cans put out too long in advance of scheduled pick-ups
  • Trash cans left out too long after trash collection
  • Newspapers not picked up - left out in driveways to become soggy unsightly mess
  • Some yards not properly maintained
  • Some homes not attractive in appearance or in run-down condition – needing paint, siding repair, attention to landscaping, fences, etc.
  • Residents sweeping/blowing grass clippings and other debris down the storm drains – this may result in neighborhood flooding!
  • It is unlawful for homeowners to burn yard brush, tree limbs, trash, etc.
  • Vehicles stored (not in use) on property
  • Trees and shrubs kept trimmed back as not to block sidewalks or street
  • Homeowners letting pets run loose in neighborhood
  • Please pick up pet waste and dispose of it properly

Please take pride in the appearance of your property.  Please report appearance and maintenance issues to the ATHOA board.

 


Semi Annual Garage Sale

The Spring and Fall Garage Sales are scheduled for Saturday on the first weekend in April and the first weekend in October each year from 8:00am to 2:00pm.  If it rains the garage sale will take place the following weekend.  All homeowners who plan to participate in this event are asked to display balloons (NOT SIGNS!) as an indicator of participation in the event.
